A recent AAJ article says that the National Transportation Safety Board cited a lack of appropriate federal safety standards and driver fatigue as contributing factors in this deadly crash where nine people died. The AAJ is calling for new regulations directed at improving the safety of passengers on commercial transportation vehicles. Proposed standards would include installation of electronic devices to monitor driver fatigue, seat belts, and stronger vehicle construction. Commercial trucks are also included in this call for more stringent standards.
Fourth Department Denies Dismissal of Ski Lift Case

In Tone v. Song Mountain Ski Center (Fourth Department January 2014), the appellate court reversed the trial court’s dismissal of plaintiff’s personal injury action for injuries caused while on a ski lift. The plaintiff sustained injuries while using a triple chair left at defendant’s facility. Defendant claimed that
